Our Commitment to Intellectual Property
QBZon respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 and specifically in accordance with 17 USC § 512(c)(3), QBZon will respond expeditiously to claims of copyright infringement committed using the QBZon service and/or any QBZon website (the "Site").
Upon receipt of a valid DMCA Notice as described below, QBZon will take whatever action, in its sole discretion, it deems appropriate, including removal of the challenged content from the Site.
DMCA Notice of Alleged Infringement
If you are a copyright owner, authorized to act on behalf of one, or authorized to act under any exclusive right under copyright, please report alleged copyright infringements taking place on or through the Site by submitting a DMCA Notice of Alleged Infringement that complies with all requirements outlined below.
DMCA Notice Requirements
Your DMCA Notice must include the following information to be considered valid:
1. Identify the Copyrighted Work
Identify the copyrighted work that you claim has been infringed. If multiple copyrighted works are covered by your Notice, you may provide a representative list of the copyrighted works that you claim have been infringed.
2. Identify the Infringing Material
Identify the material or link you claim is infringing (or the subject of infringing activity) and to which access is to be disabled. Include at minimum, if applicable, the URL of the link shown on the Site or the exact location where such material may be found.
3. Provide Your Contact Information
Provide your company affiliation (if applicable), mailing address, telephone number, and, if available, email address.
4. Include Required Legal Statements
Include both of the following statements in the body of the Notice:
Statement 1:
"I hereby state that I have a good faith belief that the disputed use of the copyrighted material is not authorized by the copyright owner, its agent, or the law (e.g., as a fair use)."
Statement 2:
"I hereby state that the information in this Notice is accurate and, under penalty of perjury, that I am the owner, or authorized to act on behalf of, the owner, of the copyright or of an exclusive right under the copyright that is allegedly infringed."
5. Provide Your Legal Signature
Provide your full legal name and your electronic or physical signature.
Important Legal Warnings
FALSE DMCA CLAIMS ARE ILLEGAL
Submitting a false, fraudulent, or bad faith DMCA notice is illegal and punishable under federal law. This includes submitting notices for material that is not actually copyrighted or for which you do not hold the copyright.
Any false DMCA notice will be met with strong legal action, including civil and criminal penalties to the fullest extent permitted by law.
Consequences of False Claims
- Civil liability for damages, costs, and attorney's fees
- Criminal penalties including fines and imprisonment
- Liability under 17 USC § 512(f) for damages caused by misrepresentation
- Potential legal action by the notified party
Fair Use Notice
Please note that not all uses of copyrighted material constitute infringement. Fair use, including uses for commentary, criticism, news reporting, teaching, scholarship, or research, may be protected under 17 USC § 107. Before submitting a DMCA notice, ensure that the use is not a fair use.
